1. About us

This website is operated by Alarabia Store Ltd, trading as Smarty Store (referred to as “Smarty Store”, “we”, “us” or “our”). We provide this website, its content, products and related services (together, the “Services”). Our online store is powered by Shopify.

Please read these Terms carefully before using the Services or placing an order. By using the Services, you agree to these Terms and our Privacy Policy. Nothing in these Terms affects your statutory rights as a consumer.

2. Access and accounts

By using the Services, you confirm that you are legally capable of entering into a binding contract with us. If you are under 18, you should use the Services only with the involvement and permission of a parent or legal guardian where appropriate.

You must provide accurate, current and complete information when creating an account or placing an order. You are responsible for keeping your account credentials secure and for activity carried out through your account. You must not transfer or sell your account to another person.

3. Products and descriptions

We take reasonable care to display and describe products accurately. Colours and appearance may vary slightly depending on your screen and device settings. Product packaging may occasionally change without notice, but this does not affect your rights if an item is materially different from its description.

Product availability and quantities may be limited. We may withdraw or change a product at any time before accepting an order.

4. Orders and contract formation

Placing an order is an offer to buy the products in your basket. An automated acknowledgement does not mean that we have accepted your order. A contract is formed when we send confirmation that your order has been accepted or dispatched, whichever occurs first.

We may refuse or cancel an order before acceptance, including where an item is unavailable, pricing or product information is incorrect, payment is not authorised, or we reasonably suspect fraud or misuse. If payment has already been taken for an order we cancel, we will refund it using the original payment method.

Please check your order carefully before submitting it. Cancellation and return rights are explained in the Refund and Returns Policy below.

5. Prices and payment

Prices are shown in pounds sterling and include applicable UK taxes unless stated otherwise. Delivery charges, where applicable, will be shown before you complete checkout.

Prices and promotions may change without notice, but changes will not affect an order we have already accepted. Prices on our website may differ from prices in our physical store or on third-party marketplaces.

You confirm that you are authorised to use the payment method supplied and that the billing information you provide is accurate.

6. Delivery

Available delivery methods, charges and estimated times are shown at checkout. Unless we agree otherwise, we will deliver without undue delay and within 30 days after the contract is formed.

Delivery dates and times are estimates unless we expressly agree a guaranteed date. We are not responsible for delay caused by events outside our reasonable control, but we will contact you where appropriate and take reasonable steps to minimise the effect of the delay. Your statutory rights remain unaffected.

Where we arrange delivery to a consumer, responsibility for the goods remains with us until they are delivered into the physical possession of you or a person you identify to receive them. This does not apply where you independently commission a carrier whom we did not offer as a delivery option.

You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you notice an error.

7. Your cancellation and return rights

Your rights to cancel an online order, return goods and receive a refund are set out in the Refund and Returns Policy below. That policy forms part of these Terms.

8. Intellectual property

The content made available through the Services, including our text, graphics, photographs, videos, designs and branding, is owned by or licensed to Smarty Store or the relevant rights holder and is protected by applicable UK and international intellectual property laws.

You may use the Services only for personal, non-commercial purposes. Unless permitted by law or authorised by us in writing, you must not copy, reproduce, modify, distribute, republish, commercially exploit or otherwise use material from the Services.

Nothing in these Terms transfers ownership of any trademark, copyright, design, trade name or other intellectual property belonging to Smarty Store, Shopify or any third party. Third-party trademarks and product names remain the property of their respective owners.

9. Third-party services and links

The Services may contain links to, or tools supplied by, third parties. Their own terms and privacy policies may apply. We are not responsible for third-party websites or services that are outside our control. This does not exclude any responsibility we have under applicable law.

Shopify provides the ecommerce platform used for our online store, but purchases from our store are made from Smarty Store.

10. Privacy

Our collection and use of personal information is explained in our Privacy Policy. Shopify may also process personal information to provide the ecommerce platform. Please review our Privacy Policy and Shopify’s applicable privacy information for further details.

11. Reviews and feedback

If you submit a review, photograph, suggestion or other feedback, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that feedback for operating and promoting our business.

We may remove content that we reasonably believe is unlawful, misleading, abusive, obscene, infringing or otherwise breaches these Terms. We will not suppress a genuine review merely because it is negative.

12. Errors and availability

Website information may occasionally contain an error or omission relating to a description, price, promotion, delivery charge, delivery time or availability. We may correct an error and, where necessary, reject or cancel an affected order before acceptance. If we cancel after taking payment, we will provide a refund.

13. Prohibited uses

You must not use the Services:

  • in breach of any applicable local, national or international law or regulation;

  • fraudulently, maliciously or in a misleading way;

  • to infringe another person’s intellectual property, privacy or other legal rights;

  • to upload malware or interfere with the security or proper operation of the Services;

  • to gain unauthorised access to an account, system or data;

  • to scrape, copy or commercially exploit the Services without permission; or

  • to harass, threaten, defame or impersonate another person.

We may restrict, suspend or terminate access where we reasonably believe these Terms have been materially breached.

14. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary to protect the Services, comply with law, prevent fraud or respond to a material breach of these Terms.

Termination does not affect rights or obligations that arose before termination. Provisions that by their nature should continue—including intellectual property, liability, governing law and dispute provisions—will remain in effect.

15. Website availability and statutory rights

We take reasonable care to keep the Services secure, accurate and available, but we do not promise that website access will always be uninterrupted or error-free.

Products must be as described, of satisfactory quality and fit for their intended purpose where required by the Consumer Rights Act 2015. Nothing in these Terms excludes or restricts any right or remedy that cannot lawfully be excluded or restricted.

16. Our liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory rights, or any other liability that cannot legally be excluded or limited.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

If you use the Services for business purposes, our liability will be limited only to the extent permitted by law.

17. Your responsibility

You are responsible for losses reasonably incurred by us because of your unlawful use of the Services or material breach of these Terms, to the extent permitted by law. Nothing in this section removes or reduces any protection available to consumers under UK law.

18. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as removed only to the extent necessary. The remaining provisions will continue in effect.

19. Waiver and entire agreement

If we do not immediately enforce a right under these Terms, that does not mean we have waived it.

These Terms and the policies referred to in them form the agreement between you and us concerning the Services. They do not exclude any representation or right that cannot lawfully be excluded.

20. Transfer of rights

You may transfer your rights under these Terms only with our written consent, except where applicable law permits otherwise. We may transfer our rights and obligations to another organisation, but we will not do so in a way that reduces your statutory rights. We will notify you where required by law.

21. Governing law and disputes

These Terms and contracts between you and Smarty Store are governed by the laws of England and Wales.

If you are a consumer resident in Scotland or Northern Ireland, you also retain any mandatory protections available under the law where you live and may bring proceedings in your local courts where applicable. Otherwise, disputes may be brought before the courts of England and Wales.

22. Changes to these Terms

We may update these Terms by posting a revised version on this page. Changes will apply from the stated effective date and will not retrospectively alter an order already accepted. Where required by law, we will give appropriate notice of a material change.
